Here is something an ITIN-selling website won't tell you: a Pakistani freelancer working from Pakistan for US clients usually has no US tax filing obligation at all. Most Pakistani Freelancers Don't Need an ITIN. Here's the Logic.

US tax law taxes nonresidents on US-source income — and for services, the source is where the work is performed, not where the client sits. A freelancer in Lahore writing code for a client in Texas is earning Pakistan-source income in the eyes of the US system. No US filing obligation, no ITIN requirement, regardless of how many dollars arrive.

What your US client usually needs from you is Form W-8BEN: a one-page certificate of foreign status that tells their accounting system not to treat you like a US contractor. It works with your foreign status in the typical case — no ITIN attached. We help clients complete it correctly, and that is often the entire engagement.

A client or platform withheld US tax from your payments. A Form 1040-NR refund claim gets it back — and that return is a genuine ITIN case.

A treaty position

Claiming US–Pakistan treaty benefits on a return requires a US taxpayer number to claim them with.

My US client asked for a tax form. Which one?

For an individual freelancer in Pakistan, almost always Form W-8BEN. It certifies to your client that you are a foreign person, which is what prevents them issuing the wrong forms or withholding US tax from payments for services you perform in Pakistan. It does not require an ITIN — the form works with your foreign status alone in the typical service-provider case.

So when does a freelancer genuinely need an ITIN?

The real cases: US tax was actually withheld from your income and you need to file a 1040-NR to claim it back; you have US-source income of a type that creates a filing obligation; you are claiming US–Pakistan treaty benefits on a return; or you are filing jointly with a US spouse. Platform payouts from Upwork or Fiverr for work performed in Pakistan are not, by themselves, a reason.

A consultant told me every freelancer should get an ITIN 'just in case.' True?

No. An ITIN without a tax purpose is an application the IRS is entitled to reject, and even when issued it expires after three years of non-use — so a 'just in case' ITIN often lapses before the case arrives. Apply when a genuine reason exists; we will tell you the moment one does.

It can.
