How Courts Decide Custody — The Welfare Principle

No parent has an absolute right to custody. Courts weigh the child's age and attachment, day-to-day care, schooling and stability, each parent's circumstances, siblings staying together, and the child's own preference at an appropriate age. As a general practice, mothers are favoured for young children — traditionally boys to around seven and girls to puberty — but this is a guideline the welfare principle can override in either direction. The father generally remains responsible for the children's maintenance regardless of who has custody.

What to Prepare for a Custody Case

3. Conduct evidence. Messages and records relevant to the other parent's conduct — collected lawfully and early.
4. Financial picture. Maintenance claims are filed alongside custody; the father's means matter to both.
